KAJIAN YURIDIS KEBIJAKAN PEMERINTAH KABUPATEN JEMBER TERHADAP PERLINTASAN KERETA API
Abstract
This study examines the Jember Regency Government's policy on railway crossings. The focus is on the lack of accessibility for people with disabilities. This study aims to determine the Jember Regency Government's policy on addressing traffic accidents caused by railway crossings. This study uses a normative juridical approach, with a statutory and conceptual approach. PT KAI is responsible for maintaining the railway construction and repairing the asphalt if the damage is caused by railway maintenance work. However, if the asphalt damage is not caused by KAI's activities, then repairs are the responsibility of the road operator agency in accordance with the authority of the road operator, according to the status or class of the road, whether national, provincial, district, or city. The railway crossing in Pecoro Village crosses a provincial road, which is also under the authority of the Ministry of Public Works and Public Housing of the Republic of Indonesia through the National Road Implementation Agency (BBPJN).
